Preamble:

The order of products presented in the electronic catalog of NAUTISPORTS. COM is subordinated to the acceptance by the customer of the entirety of the general conditions of sale exposed hereafter.

These general conditions of sale impose themselves to the customer with the exclusion of all other conditions, in particular those in force for the sales in store, and without regard for the particular clauses added by him - except express agreement of the salesman - nor for the advertising documents emitted by NAUTISPORTS. COM or any other document.

1. Acceptance

The acceptance by the customer of the present conditions is materialized by the "validation click", as well as by the communication of his banking coordinates for the purposes of payment of his order. This validation click has the value of a handwritten signature between the parties. This double step is equivalent to the customer acknowledging that he/she has fully understood and unreservedly approves all the present conditions.

2. Products

3. Availability

Our product offers and prices are valid as long as they are on the site, within the limits of available stocks. 4. Order

5. Delivery

After confirmation of the order, NAUTISPORTS. COM undertakes to deliver, via its carrier Colissimo, all references ordered by the purchaser within a maximum period of 30 days (from the day following receipt of the order). However, this period may be extended in the event of default or delay in supply by any supplier.

Deliveries to EU countries are made by Colissimo suivi Europe. For deliveries outside the EU, deliveries are made by the international postal services.

6. Force majeure

War, riot, fire, strikes, accidents or the impossibility of being supplied by a supplier are considered as cases of force majeure discharging the seller from his obligation to deliver.

7. Withdrawal

The customer has a period of 100 clear days from the date of receipt of the order to return to NAUTISPORTS. COM any items that do not suit him/her for exchange or refund, without penalty, with the exception of the return postage, which remains at the customer's expense in the case of a refund request.

Exchanges of bulky products (life rafts, dinghies and ladders) are at the customer's expense and are subject to specific pricing, which will be studied on a case-by-case basis.

Returns must concern new items in their original packaging, accompanied by any accessories, instructions and documentation. Personalized items (embroidery, silk-screening, rope cutting, etc.) cannot be returned or exchanged. We reserve the right to refuse any returned product if it does not meet these conditions (missing product, damaged or stained product, etc.).

Items returned incomplete, damaged or used will not be accepted.

In the event of abnormal or abusive returns, NAUTISPORTS. COM reserves the right to refuse a subsequent order.

If you wish to exercise your right of withdrawal, please use our withdrawal form and we will immediately send you an acknowledgement of receipt of the withdrawal on a durable medium (e. g. by e-mail). You can also use the attached form and return it to us by post.

In the event of exercising the right of withdrawal, NAUTISPORTS. COM is obliged to reimburse the sums paid by the customer, free of charge, with the exception of the cost of returning the goods. Reimbursement is due within a maximum of 14 days and will be made using the same means of payment used at the time of purchase.

8. Prices

The price is expressed in Euros.

The price indicated on the product sheets does not include transport.

The price invoiced to the customer is the price indicated on the order confirmation sent by NAUTISPORTS. COM. This price is expressed inclusive of all taxes and includes VAT for France and EU countries. It includes the price of the products, the costs of handling, packaging and conservation of the products, the costs of transport and commissioning.

If the customer has a discount code, he will enter it in the order in the box provided for this purpose in the basket. Unless expressly stated, discount codes are not cumulative. Moreover, once the order has been validated and paid for, it is no longer possible to add a discount code after the fact.

NAUTISPORTS. COM reserves the right to modify prices at any time. However, for all accepted orders, NAUTISPORTS. COM guarantees the prices in effect at the date of order confirmation by NAUTISPORTS. COM.

9. Payment

The price of the products is payable in cash on the day of the effective order and the payment is carried out by bank card, transfer or Paypal.

Our site is the subject of a system of security of payment via the Lyra module.

Lyra enables customers to pay online via a bank server in a secure environment. The customer's credit card number is therefore sent to the bank's servers, and payment is made directly to a bank in a secure environment, without passing through the store's server. This guarantee is all the more important as the numbers are known only to our banking partner.

The order validated by the customer will not be considered effective until the bank payment centers concerned have given their approval. 12. Liability

The products offered conform to current French legislation and to standards applicable in France. NAUTISPORTS. NAUTISPORTS. COM's liability is systematically limited to the value of the product in question, at the date of sale, without any possibility of recourse against the brand or company producing the product.

If the buyer applies to the courts, he must do so within a "short period" from the discovery of the hidden defect (art.1648 of the French Civil Code).

13. Personal information

The personal information collected for the purposes of distance selling is compulsory, as this information is indispensable for processing and routing orders, and drawing up invoices and warranty contracts. Failure to provide this information will result in the order not being validated.

In the event of difficulties in the application of the present contract, the customer has the possibility, before taking any legal action, of seeking an amicable solution, notably with the help of a professional association in the sector, a consumer association or any other advisor of his choice. Please note that seeking an amicable solution does not interrupt the "short time limit" of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty assumes that the buyer honors his financial commitments to the seller.

Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in those who take the trouble to expose such situations. In the event of a dispute, the customer should first contact the company for an amicable solution.

Failing this, French law shall have sole jurisdiction.

15. Warranty

Products sold on NAUTISPORTS. COM are guaranteed for 1 year, unless otherwise stated on the product sheet. The defective product will be able to be turned over after preliminary agreement by contacting NAUTISPORTS. In the event of an action under the legal warranty of conformity, the consumer :

• has two years from the date of delivery of the goods to take action

• may choose between repairing or replacing the good, subject to the cost conditions stipulated in article L.211-9 of the French Consumer Code.

• is exempted from proving the existence of a lack of conformity for 6 months following delivery. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

The legal warranty of conformity applies independently of the commercial warranty.
Should the consumer decide to invoke the warranty against hidden defects in the item sold as provided for in article 1641 of the French Civil Code, he or she may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the said code.
